If you're making a left turn, or waiting for someone to make a left turn, and you have a green light - just be cautious! 
Looking at the research, 30% of the accidents here are rear-ends! It's people not paying attention.
Yes! Or is it people not leaving enough distance, so we're tailgating? 
Yeah that can definitely be it too. I see it all the time - I represent a lot of motorcycle riders. They're sitting at a light, and they get hit! How does that happen? 
Somebody is too close to you!
Yes, and someone is looking down at their phone, all of a sudden, they look up, and everyone is stopped. Same thing on the freeway - people aren't paying attention. When they change lanes, they aren't looking. Or they do it quickly and think they can weave in and out of traffic. 
You've been in this game a long time. Do you find that things are different now with smart phones and more distracted driving?
Yes! And we are always preaching to people to get off their phones. Now they have those little phone stands, but they're still looking at it!
Exactly! My aunt gets me the little stand for my phone, and I'm thinking, "well, what's the difference?!" Or there is the screen in your car that has the navigation. So you're looking at it thinking, "Where's my turn?" and if you don't have a safe distance, then you might collide. A lot of things are common sense to be safe on the road, but some things are maybe good to remind people. Obviously, don't be impaired or distracted, but you have some other tips?
That's a huge point - if you're drinking AT ALL, get a ride home. Some people have a little to drink and think they're okay to drive and find that they are just slower and their reaction time isn't there. 
Yeah, it's amazing because if you've had even one drink, the reason you had that one drink was to alter your mood - which also alters your reflexes!
Exactly. So if you've had a drink, get a ride home, call an Uber. And just as a general rule of thumb, just BE CAUTIOUS. Be cautious of those around you. I ride a lot of motorcycles, and I always give myself distance. Even though I'm on a bike, I act like a big truck. I am not weaving in and out of traffic. Realize if you're in someone's blindspot. Yeah and you know, especially that scenario when you're at an intersection, and people are kind of waiting, they're making a left turn, waiting for the cars to come through. And they don't see the motorcycle guy behind the big truck, so they make that turn and then bam, you're right in front of a motorcyclist and bam, they're seriously hurt. And there's so many other ways, you know, merging onto the freeway - that happens a lot. A lot of the bikers will be on the left lane so they steer clear of the merge lane. Have you ever seen anyone go from the merge lane and get clear over [into the fast lane]. If I could just put a plug in since COVID, settle down! Be safe, be courteous - it's not about getting somewhere too fast because guess what: if you get in an accident and somebody gets hurt, it's never worth it. 
Let's talk about a motorcycle and things that need to be done. First, let's talk about the motorcycle person. So if they're in an accident, what should they do, or what are some things they need to make sure they're covered for?
Well, uninsured motorist coverage is a big one, like we talked about earlier. Sometimes if there is low coverage, as a motorcyclist, they have no shield. So if the other person has low coverage or no coverage, you need to be protected. So if you're riding a bike, you need to have $250,000 UIM coverage, and just to protect yourself at least. The other thing is the gear that you wear - it's not required that you have a helmet in the state, but you best have one! 
Especially because of the way some people are driving! Also, I want to say this about motorcycles riders: and nothing against them, but I do hate the ones who want to show off. The ones who have the "rockets," as we like to call them, and take off through traffic, weaving through, not knowing that, really, you're not supposed to do that. That whole law is when traffic is stopped, not for you when you're traveling, when traffic is moving, you're not supposed to be moving in and out of there, am I right?

When it comes to major accidents, we are taken to the hospital, but when it comes to minor wrecks, we make one big mistake. Here to tell us what that mistake is, is Attorney Lloyd Baker. When we are in a minor accident, we do one mistake that is:
So I call these "low-damage cases" because sometimes there is no damage to the vehicle, but there is a lot of damage to the person. The biggest problem, as you pointed out, is that people just think, "my pain is going to go away, my headache is going to go away, or my neck will feel better," especially men. Now it's been a few months, and should I start going to the doctor now? But by then it's too late. So basically, that's the issue - people think the pain will go away, but later find that they have a slipped disc, and are dealing with tingling down their arms or legs. All of those are signs that you're in pain and there is a problem. 
What happens with that, is that if you didn't go get checked out - even if you go to an urgent care or somewhere afterwards, you have that information there. Because down the line, if you do need to sue for medical, you won't really have a chance because you should've taken care of it right then. Because like you said, down the line, it doesn't go away.
Right, and down the line, insurance companies won't buy it, the jury won't buy it. At least you need to show some consistent treatment. So get checked out at least! Especially if you have children - they are pretty tolerant to pain and to injury. It doesn't seem like they get as injured as older adults. I'd still get them checked out. It shows consistency of care, and it's a lot easier to see a result. 
Because people don't realize how bad a minor accident can be. They think because the speed was low and that their airbags didn't go off that, "I'm fine." However, that's not the case. When you are in those minor accidents, really look at how fast you were going, what's going on, that way you have that record too.
Engineers look at stuff like that, you know. Because of the way vehicles are made nowadays, they can take a lot of crunch, a lot of pressure. It's the energy that flows through the vehicle, and sometimes, they said when you don't have as much damage, it's more of a complete impact, where the energy is circulated right to the human. Sometimes with the lower impact wrecks, I've had people have double surgeries on, with no damage to the car whatsoever. 
Right, and if you don't have the right insurance for those medicals, that's when you need to come in, of course, you and your team (Lloyd Baker) are there to fight for them to make sure that you do get that help. Or even if you do have that kind of wreck, sometimes the insurance companies don't want you to take care of it.
Yeah, I worked for State Farm for years, and it's a great company, but they tell you that you don't need a lawyer. They know they'll have to pay more. 
With school back in session, and more kids on the road, who is responsible to file these claims, and if there is something major, who can get a lawyer?

It's hard to deal with when you've been in an accident, and you don't feel great, and then you have to deal with the insurance companies and all of that. So tell us a little about if someone is in an accident, how long they have to file a claim.
So, there's a statute of limitations with all accidents. So it's a two-year in Arizona. If it is against the government or any government entity, it is six months. So, you have to make sure that that's a notice of claim you have to file before you can file an actual case. So be aware of that. If it's, you know, if it happens on, in somebody else's responsibility, that's, that's a government entity that's, that's quick.
Absolute right. Two years versus six months. So very important. Make sure you call your attorney quickly. And there are just so many pitfalls that you can avoid by doing that. So, and that's part of what would some of those be?
So, collecting evidence, the witnesses, evidence disappears. We can get accident scene investigators out there looking at the what, who, who did what on cameras. Because sometimes there's a 7-Eleven or somewhere, somebody may have a dash cam that we need to preserve. So, the sooner, the better for those kinds of things. It's essential to get better and get to a doctor. Timing is imperative; ensure you take care of that quickly. 
I want to make sure I say this correctly. So, is your insurance claim worth more than the adjuster possibly tells you? So this is also a tricky question. So walk me through how that could happen and what the cases could be.
So, I worked for an insurance big insurance company for several years before I became an attorney. And they're always told to save the insurance company money, right? They're always going lowball you. When the big boys and you're sitting in a meeting, they're basically pretty much all the people in management are over here, very conservative, and then all the actual adjusters are over here. Well, I think it's worth more money. And so, we have to bridge that gap. That's what the attorneys are for. Make sure that they pay and pay you what you deserve. The insurance companies are there to make money,  and the claimant's lawyer is trying to get the maximum amount of money. So you have to know what is fair.
As a client, is there a way that you can go to your adjuster and ask for them to look at it again? How do you know if they are lowballing and to look at your claim again.
You need experience. That's why you get an experienced attorney. The claimants can get three and a half times more money – by hiring an attorney. That is a study that the insurance companies have done. And sometimes, just from facts, it's much more than that. 
So that we've had that leads us to the next question, which is, as we discussed in the opener, that not all attorneys are created equal. No, they're not. And that is something right there, the experience, the know-how. You said you've worked with the insurance company in and a big insurance company. Yeah. You know, this stuff. What are other things that make attorneys different that people should look for when they have the situation? 
So, number one, will they go to court because that's, it's going to court is like having a sledgehammer over their heads. It forces them to do the right thing. Many times, we do have to file cases so, and to get the maximized value out of a claim. You want an empathetic attorney. When I was 16, I was broadsided by a car that ran a stop sign. I was on my motorcycle. So, I understand it. It's very frustrating. People don't know what to do. They have to get better. They have to go to a doctor. How am I going to pay for this? Now I can't work. What do I, you know, all those kinds of issues come up, and you need somebody caring and, and has done it before and, and they can take good care of you. I mean, we have a team of, they are very empathetic and caring about winning for our clients. And so those are the significant issues. You know, are you going to file a case, and when you file a lawsuit, you get the maximum value. It would be best if you had an aggressive lawyer. Not, not aggressive, verbally. It's not in a wrong way—an attorney who will fight for you and your rights.

If you have been in an accident, timing is everything. Today we are talking with Lloyd Baker with Lloyd Baker Injury Attorneys. This is something that maybe not everybody knows but give us a little bit of information about the sensitivity around timing because this is something that I don't know if I was in an accident, I would know.
The evidence seems to disappear, so the quicker you get it, the better off you are. So, pictures,  EDRs from your vehicle tell you the speed,  dash cams. There's usually a camera somewhere or a witness somewhere that sees something. If you wait, there may not be a proper investigation, which is the problem. People miss out on a lot of evidence that could prove that they were not at fault for the accident, which makes pictures of the accident super important. Witnesses, saving evidence, seeing a doctor and making sure your attorney has all this information is the most important.
And you make a really, great point about the fact that there are cameras everywhere. So there, when people come to work with you, because you are a personal injury attorney, is this something that people bring all of this to you? Do you help them get all this information, all this evidence? How does that relationship work?
It's both. They'll often have a dash cam, which helps us; okay, what color was the light? We can look and see, and so on and also, there's a 7-Eleven on every corner, or a convenience store, and so somebody's going to have footage of this somewhere.
It's 2023. Yes. Yeah, we've done that. We've gotten McDonald's footage, I mean,  to show what's going on. We obviously chase that stuff too. So, we want to preserve everything we possibly can because, every time, occasionally, it's not in favor of our client, which is important to kow up front.  Before they go and spend a bunch of time and effort treating when they,  probably won't recover. It's a necessary evil.  People are so grateful that we attack and get things done and are aggressive about our representation and getting the facts and the evidence because it does help them.
Tell us a little bit about when people start working with you. How does that process go? What, what are the initial kind of steps when they work with you?
Well, nowadays, all you do is pretty much it's all digital. So, you can, they can digitally sign. As soon as we get that going, we can represent them. Our priority is preserving evidence, that's what we're all about.  We make sure to get our clients back to life, we get them to the doctor, get them lined up. Sometimes they don't even know what to do because they aren’t sure who will pay for it all.
So, you can put a doctor on a lien, we have connections like that. Sometimes if our clients are from different countries, they aren’t sure if they should treat since they haven’t done this before. We help guide them into what they need.
Yeah, that's a huge point right there helping guide someone. Because I wouldn't know if, God forbid, I was in an accident or something like that, I wouldn't know my next steps. So, when it comes to things like an insurance company, is there a hard and fast rule? Is there like a, you have two weeks, and then that's it. How long do you have with an insurance company to file a claim?
Well, for your own insurance, you need to let them know - right away. On the other side, though, we can let them know. And many times, people try to do it on their own, and that's when they encounter problems because they didn't get the proper treatment and preserve all the evidence. We help our clients understand that they can treat, get better, and there is someone to pay for it.

If you have been in an accident, timing is everything. Today we are talking with Lloyd Baker with Lloyd Baker Injury Attorneys. This is something that maybe not everybody knows but give us a little bit of information about the sensitivity around timing because this is something that I don't know if I was in an accident, I would know.

The evidence seems to disappear, so the quicker you get it, the better off you are. So, pictures, EDRs from your vehicle tell you the speed, dash cams. There's usually a camera somewhere or a witness somewhere that sees something. If you wait, there may not be a proper investigation, which is the problem. People miss out on a lot of evidence that could prove that they were not at fault for the accident, which makes pictures of the accident super important. Witnesses, saving evidence, seeing a doctor and making sure your attorney has all this information is the most important.

And you make a really, great point about the fact that there are cameras everywhere. So there, when people come to work with you, because you are a personal injury attorney, is this something that people bring all of this to you? Do you help them get all this information, all this evidence? How does that relationship work?

It's both. They'll often have a dash cam, which helps us; okay, what color was the light? We can look and see, and so on and also, there's a 7-Eleven on every corner, or a convenience store, and so somebody's going to have footage of this somewhere.

It's 2023. Yes. Yeah, we've done that. We've gotten McDonald's footage, I mean, to show what's going on. We obviously chase that stuff too. So, we want to preserve everything we possibly can because, every time, occasionally, it's not in favor of our client, which is important to kow up front. Before they go and spend a bunch of time and effort treating when they, probably won't recover. It's a necessary evil. People are so grateful that we attack and get things done and are aggressive about our representation and getting the facts and the evidence because it does help them.

Tell us a little bit about when people start working with you. How does that process go? What, what are the initial kind of steps when they work with you?

Well, nowadays, all you do is pretty much it's all digital. So, you can, they can digitally sign. As soon as we get that going, we can represent them. Our priority is preserving evidence, that's what we're all about.


We make sure to get our clients back to life, we get them to the doctor, get them lined up. Sometimes they don't even know what to do because they aren’t sure who will pay for it all.
So, you can put a doctor on a lien, we have connections like that. Sometimes if our clients are from different countries, they aren’t sure if they should treat since they haven’t done this before. We help guide them into what they need.
Yeah, that's a huge point right there helping guide someone. Because I wouldn't know if, God forbid, I was in an accident or something like that, I wouldn't know my next steps. So, when it comes to things like an insurance company, is there a hard and fast rule? Is there like a, you have two weeks, and then that's it. How long do you have with an insurance company to file a claim?

Well, for your own insurance, you need to let them know - right away. On the other side, though, we can let them know. And many times, people try to do it on their own, and that's when they encounter problems because they didn't get the proper treatment and preserve all the evidence. We help our clients understand that they can treat, get better, and there is someone to pay for it.
