Personal Injury Claim

Lloyd Baker How Long Does an Average Personal Injury Case Take?

June 23, 2025

Average cases, usually, it’s almost a bell curve, and it’s about 18 months. Because it takes about six to nine months to a year to stop treating. And depending on how badly somebody’s injured, the process takes a while, and so you’ll have some of them that will settle relatively soon, but the majority of them actually within about the 18 months, and then that’s about the mid-range, and then there’s a lot of them that end up at the end that go into trial that can take two or three years.

Most of them settle within 18 months. Smaller cases, a lot of times will settle within the first six months

Bigger cases usually take longer just because you’re treating longer, there’s more evidence that’s collected, more doctors, more experts, things like that that have to be gotten before you’re really ready to settle.

The worst thing you could do is settle your case early. I know that sounds funny, but, you know, ’cause of the time value of money, but if you’re too willing to settle your case for little to nothing, that’s a problem.

Obviously, we wanna maximize your recovery. And to maximize your recovery, sometimes you have to prepare a case a little longer. And so, it varies, obviously. We do settle cases. We’ve actually settled some cases within the first 90 days. And usually that’s because they’ve already treated, they have huge medical bills and a small policy. So they just say, “Here’s the policy”. And so, those kinds of things happen, but that’s not the average.
